When and How to Request a Child Support Modification

Child support is regular payments made by one parent to another for financial care and support of their children. How Are Child Support Payments Calculated?

In the U.S., there are three ways to calculate child support payments and issue child support orders:

·  Income Shares

This formula works on the assertion that minor children should receive the same financial support as they would have if their parents stayed together. The computation is based on how much each parent would have used of their income to support the child in their household. The calculation may vary by state, but essentially, this approach considers both incomes to reach a final amount. If the custodial parent earns less than the non-custodial parent, the non-custodial parent will pay more toward child support.

·  Percentage of Income

This calculation model takes a percentage of the non-custodial parent’s salary to determine the child support amount. It assumes that the custodial parent’s support amount is spent only on the child. The total is adjusted in the same way as per the income shares formula.

·  Melson Formula


Whereas the income shares calculation is basic, the Melson formula is a level-up. It includes a standard of living adjustment, giving children the right to share in both parents’ increased income. The calculation covers the basic needs of the child, unusual or unexpected medical expenses, childcare, and SOLA. All these amounts are combined, and the parent’s individual needs are considered. Finally, the parents’ total net income is added to this calculation to establish the child support payment.  

Why Request a Child Support Modification

Typically, parents decide on the specifics of a child support order during their divorce proceedings. When the order is issued, it must reflect the financial status and capabilities of both parties. But, like everything else, financial circumstances can change overnight. One parent may lose their job or ability to work. Conversely, one parent may receive a substantial salary increase or a large inheritance. 

A child support modification request will likely be required if the paying parent’s income increases or decreases. The same goes for when a child’s needs start evolving. They may want to participate in extracurricular activities or an annual summer camp. These additional needs have to be factored into the modification request. The child may also be diagnosed with a chronic or severe illness that requires ongoing medical care. This can lead to a request for a higher child support payment. Lastly, a child support modification is also necessary if a parent is imprisoned or deployed to active military service.

These agencies will also provide the specific forms you need to complete to initiate a modification request. An agency may make the forms available on their website, but you’ll likely have to request them in person. 

Explain the Reason for Modification

The forms include a dedicated blank space where you can detail why you’re requesting a modification. Take the opportunity to provide a detailed explanation and be upfront about how your circumstances have changed since the issuance of the original order.

Submit the Forms and Documents

When you’ve completed the forms and are satisfied that your explanation is valid, you can submit them to the agency. Don’t forget to include copies of your pay stubs, tax returns, and other documents to substantiate your request. 

Attend a Review Meeting (If Requested)

You may need to attend a review meeting with a child support case worker. An agency may request this meeting to review your documents or ask for additional documentation. It is also an opportunity to explain your situation in person.
